Policy Change
By default, Arta shipments use the incoterms DAP (Delivered at Place) or DDU (Delivered Duty Unpaid), where the buyer is responsible for paying import duties, taxes, and fees directly to the carrier upon arrival into the destination country.
However, in rare situations, the carrier may now legally invoice Arta (as a third-party account holder) for these charges. We are seeing these invoices from FedEx, UPS and DHL. This can be the result of not being able to reach the importer or other exceptions that occur during the carrier’s clearance.
In such cases:
- Arta will invoice our client for any duties, taxes, or fees invoiced by carriers for your shipments at cost (no markups or fees).
- For automated billing clients, Arta will charge the Fulfillment payment method on file 14 days after the invoice is issued. Clients may dispute these charges for 7 days. See below for more information on notice and payment.
- Clients are able to invoice their customers for these fees. It is your responsibility to recoup charges. Arta invoices must be paid in 30 days regardless of whether you have received funds.
- Arta will not collect payment or mediate disputes with importers directly. We will provide all available documentation and file disputes on your behalf.
Notification and Payment Terms
If Arta receives a carrier invoice for duties on your shipment:
- Notice: Arta will notify you via email and your account dashboard within 14 business days of receiving the carrier invoice.
- Documentation: Arta will provide a copy of the carrier’s invoice and relevant shipment details.
-
Payment Timeline:
- You must pay the invoiced amount within 30 days of notification.
- If you do not pay within 14 calendar days, Arta will automatically charge your default fulfillment payment method on file for the relevant currency.
- Dispute Rights: You may dispute a charge within 7 calendar days of notification by contacting support with evidence (e.g., proof that the carrier invoice is erroneous).
Limitation of Arta’s Liability
Arta acts solely as a payment facilitator for carrier-billed duties. Arta:
- Does not mark up or profit from pass-through duty charges.
- Is not liable for the accuracy of carrier duty calculations (disputes must be directed to the carrier).
- Is not responsible if you are unable to collect payment from your buyer.
